What Kind of Lawyer Do You Need? A Guide to South African Legal Specialities

In South Africa, the legal profession is distinct from what we often see on TV shows. We have what can is considered a “split bar” system, statutory specialists, and highly specific practice areas. Understanding these distinctions is crucial: it ensures you hire the right professional for the job, saving you time, money, and frustration.

Attorney vs. Advocate

An Attorney is your first port of call. They are the interface between the client and the law. When you hire Cuthbertson and Palmeira Attorneys, you are hiring a team of attorneys.

  • Role: They take your instructions, manage your file, draft legal letters, negotiate settlements, and handle client funds via a strictly regulated Fidelity Fund Trust Account.
  • Court Appearance: Attorneys have the right of appearance in the lower Courts, such as Magistrates’ Courts and, with additional certification, the High Court.
  • When to hire: Immediately. You almost always need an attorney to initiate any legal process, and even if you don’t strictly need an attorney to institute legal process (such as in the Maintenance Court or Children’s Court) the knowledge and experience afforded to you by an attorney can only be advantageous to your case.

The Advocate (The “Specialist Surgeon”)

Advocates (often called Counsel) are specialists in litigation and the art of persuasion in court.

  • Role: They spend most of their time in court or drafting specialized legal opinions. Traditionally, they do not take instructions directly from the public; they are “briefed” by your attorney.
  • When to hire: Your attorney will consider the facts of your case and suggest that an Advocate be briefed should your case require one. Attorneys without right of appearance in the High Court will be required to brief an Advocate for a case in the High Court. In other instances, Advocates are usually briefed for complex matters which require highly technical legal arguments.

The Statutory Specialists: Qualifications Matter

In South Africa, certain legal tasks can only be performed by attorneys who have passed additional, rigorous statutory exams. This is often where clients get confused regarding property and marriage contracts.

The Conveyancer

A Conveyancer is an attorney who has qualified to transfer real estate. No one else—not a standard attorney, and not an advocate—can sign off on property transfers at the Deeds Office.

What they do: Property transfers, bond registrations, and property subdivisions.

Why you need one: If you are buying or selling a home, a Conveyancer is legally mandated to effect the transfer of ownership.

The Notary Public

A Notary is an attorney admitted to draft and attest specific types of secure documents that require a higher level of verification.

What they do: The most common document a Notary drafts is the Antenuptial Contract (ANC). They also authenticate documents for use in foreign countries.

Why you need one: If you are getting married out of community of property, a Notary will assist with the registration of your Antenuptial Contract before the wedding.

Practice Areas: Choosing the Right Expert

Once you move past the qualifications, lawyers are defined by what they do day-to-day. Law is vast; you wouldn’t ask a foot doctor to perform heart surgery. Similarly, you shouldn’t ask a criminal lawyer to handle your company’s merger.
